Disclosure of Bad Neighbors

A seller's duty to disclose, or for that matter, a broker's duty to disclose, continues to grow into a world of unknowns. Does it also include a duty to notify that a neighbor is unpleasant? What if the neighbor routinely cleans his firearms in the front yard? As a broker, you don't want to kill the deal, especially in today's market where the deals are less frequent, but how far does this go? The legal answer to this lies somewhere in the notion that if the "defect" materially affects the value of the property, it should be disclosed. That's a good reason why brokers earn their paycheck. They are left to answer this one every time they show a property.
